§ 23-302. Recording unapproved subdivision plat.

(a) Circuit court clerk recording prohibition. --
(1) The clerk of the circuit court of Montgomery County or Prince George's County may not record a subdivision plat in the regional district unless the plat has been endorsed in writing by the county planning board.
(2) A plat is invalid if it is recorded without being endorsed by the county planning board.
(b) Power to compel. -- The Commission may institute proceedings against the clerk of the circuit court of Montgomery County or Prince George's County to compel the clerk to strike from the county land records a subdivision plat that is recorded but not approved in accordance with subsection (a) of this section.
(c) Jurisdiction. -- A court of competent jurisdiction may issue appropriate orders for purposes of this section.
