§ 18-403. Acquisition of land by commission in Prince George's County.

  •    (a) Authorization for transportation purposes. -- The Commission may acquire land in Prince George's County that is needed for State highways, streets, roads, or mass transit facilities that are shown on adopted and approved master plans and are included in the Maryland Transportation Plan described in § 2-103.1 of the Transportation Article.

    (b) Authorization for other public uses. --

       (1) The Commission may include in its budget provisions for acquiring land needed for public uses in Prince George's County, including:

          (i) schools;

          (ii) libraries;

          (iii) recreation centers;

          (iv) health services facilities; and

          (v) elder care facilities.

       (2) The Commission may not acquire land for any project that is in the capital budget of the approved capital improvement program of Prince George's County.

    (c) Effect of local law. -- All land acquisitions by the Commission in Prince George's County are subject to enactment of a local law by the Prince George's County Council.
