§ 13-310. Engaging in business without a license; penalties

(a) Engaging in business without a license -- Prohibited. -- Before conducting business in a county, a transient vendor shall obtain a transient vendor license required under this part.
(b) Additional licenses or permits. --
(1) This part does not exempt a transient vendor from obtaining any other license or permit from:
(i) the United States;
(ii) the State;
(iii) the county;
(iv) any municipality in Frederick County; or
(v) the City of Hagerstown.
(2) This part does not exempt a transient vendor from liability, tax liability, or any other regulations that may be applicable in:
(i) the United States;
(ii) the State;
(iii) the county;
(iv) any municipality in Frederick County; or
(v) the City of Hagerstown.
(c) Sales on Sunday. -- Unless otherwise allowed by law, a transient vendor may not sell goods on Sunday.
(d) Penalties. -- A person who engages in business as a transient vendor in violation of this part is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 1 year or a fine not exceeding $ 2,500 or both.
