§ 10-438. Unused donated material

  •    (a) Required information; options. -- A health care practitioner licensed under the Health Occupations Article who treats individuals for infertility shall:

       (1) provide individuals with information sufficient to enable them to make an informed and voluntary choice regarding the disposition of any unused material; and

       (2) present to individuals the option of:

          (i) storing or discarding any unused material;

          (ii) donating any unused material for clinical purposes in the treatment of infertility;

          (iii) except as provided in subsection (b) of this section, donating any unused material for research purposes; and

          (iv) donating any unused material for adoption purposes.

    (b) Exception. -- Any unused material donated for State-funded stem cell research may not be an oocyte.

    (c) Written consent. -- An individual who donates any unused material for research purposes under subsection (a)(2) of this section shall provide the health care practitioner with written consent for the donation.
