§ 16-608. Violations; penalties.[Subtitle subject to contingent abrogation.]

(a) Violations. --
(1) A manufacturer or other person that knowingly sells or offers for sale cigarettes other than by retail sale in violation of § 16-602 of this subtitle is subject to a civil penalty not to exceed $ 100 for each package of cigarettes sold or offered for sale.
(2) Under this subsection, a total amount of civil penalties imposed on a manufacturer or other person may not exceed $ 100,000 during any 30-day period.
(b) Civil penalties -- In general. --
(1) Except as provided in paragraphs (2) and (3) of this subsection, a retailer, subwholesaler, wholesaler, or other person that knowingly sells cigarettes in violation of § 16-602 of this subtitle is subject to a civil penalty not to exceed $ 100 for each package of cigarettes sold.
(2) Under this subsection, a total amount of civil penalties imposed on a retailer may not exceed $ 25,000 during any 30-day period.
(3) Under this subsection, a total amount of civil penalties imposed on a subwholesaler, wholesaler, or other person may not exceed $ 100,000 during any 30-day period.
(c) Civil penalties -- False certification. -- A manufacturer that knowingly makes a false certification under § 16-603 of this subtitle is subject to a civil penalty of at least $ 75,000 and not exceeding $ 250,000 for each false certification.
