§ 4-202. Baltimore City

(a) Applicability. -- This section applies only in Baltimore City.
(b) Fees. -- The annual license fee is $ 250.
(c) Issuance. -- The Board of License Commissioners may issue Class A2 light wine (on- and off-sale) licenses.
(d) Qualifications of applicants. -- To qualify for a Class A2 light wine (on- and off-sale) license, the applicant shall be a holder:
(1) Of a Class 3 winery manufacturer's license in Baltimore City or a Class 4 limited winery manufacturer's license in Baltimore City; and
(2) Who makes and bottles wine made from Maryland agriculture products.
(e) Privileges. -- The privileges of a holder of a Class A2 light wine license are as follows:
(1) The (off-sale) privilege authorizes the holder to sell at retail the wine produced or bottled on the winery premises for off-premises consumption only; and
(2) The (on-sale) privilege authorizes the holder to sell at retail the wine produced or bottled on the winery premises by the drink in a restaurant owned and operated by the holder of the winery license that is located immediately adjacent to the winery premises.
(f) Wine taxes. -- Wine taxes shall be imposed as provided under Title 5 of the Tax - General Article.
(g) Establishment of days and hours of sale. -- The Board of License Commissioners shall establish the days and hours of sale under this license.
