§ 10-101. Where to be filed

  •    (a) Generally. -- Every application for a manufacturer's or for a wholesaler's license, or for any form of a Class E (on sale -- steamboats) or of a Class F (on sale -- railroads) or of a Class G (on sale -- airplanes) license shall be filed with the Comptroller. Every application for any of the other licenses for which this article provides shall be filed with the local licensing board where the place of business is to be located.

    (b) Place of business deemed within county, etc., where major portion lies. -- Whenever the place of business sought to be licensed lies in more than one county, or in the City of Baltimore and a county, it shall be deemed to be wholly within the county or the City of Baltimore where the major portion lies; and all alcoholic beverage laws of that place shall govern the licensing, regulation and operation of the entire place of business.

    (c) Place of business lying equally in more than one county, etc. -- Whenever the place of business sought to be licensed lies equally in more than one county, or in the City of Baltimore and a county, it shall be deemed to be wholly within the county or the City of Baltimore which has the most expensive license fee; and all alcoholic beverage laws of that place shall govern the licensing, regulation and operation of the entire place of business. The local collecting agent collecting a fee for a license under this subsection shall remit equal portions of the fee to the local collecting agents in the counties or county and city where the place lies.
