§ 2-805. Violations; penalties[Subtitle subject to contingency and abrogation]

  •    (a) Violations. -- A person may not violate a provision of this subtitle, the Northeast Interstate Dairy Compact, or a regulation adopted under this subtitle or the Northeast Interstate Dairy Compact.

    (b) Civil penalty. -- Instead of pursuing criminal charges provided in this article, the Secretary may impose on any person who violates this subtitle a civil penalty of:

       (1) For a first violation for which a civil penalty is imposed, not more than $ 500;

       (2) For a second violation for which a civil penalty is imposed, not more than $ 1,000; or

       (3) For a third or subsequent violation for which a civil penalty is imposed, not more than $ 2,000.

    (c) Dispostion of penalties. -- Penalties collected by the Secretary under this section shall be paid into the General Fund of the State.

    (d) Separate violations. -- Each day that a violation continues is a separate violation.

    (e) Regulations. -- The Secretary shall adopt regulations necessary to carry out the provisions of this section.
